Terms of Service

These Terms of Service (“Terms”) govern your use of the PlantCatcher mobile app (the “App”), which is operated by Caporuscio Consulting, LLC. By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

PlantCatcher lets you photograph plants, receive identifications from third-party providers, and build a collection. Identifications are automated estimates and may be incorrect or incomplete.

2. Educational use only — assumption of risk

All plant information in the App, including edibility, toxicity, benefits, and preparation notes, is provided for general educational and entertainment purposes only. It is not medical, health, dietary, or professional foraging advice.

• Never eat, touch, brew, or otherwise use any wild plant based on the App. Many edible plants have toxic — sometimes deadly — lookalikes, and automated identification can be wrong.
• Always confirm identification with a qualified expert before any handling or consumption.
• You assume all risk arising from your use of plant information. To the fullest extent permitted by law, we are not liable for any harm, illness, injury, or loss resulting from reliance on the App.

3. Subscriptions and billing

PlantCatcher offers optional auto-renewing subscriptions (“PlantCatcher Plus”). Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Any free trial converts to a paid subscription unless cancelled at least 24 hours before the trial ends. You can manage or cancel subscriptions in your device’s App Store account settings. Prices are shown in the App and may vary by region.

4. Acceptable use

You agree not to misuse the App, including attempting to disrupt it, reverse-engineer it, or use it to harm protected species or their habitats. Do not use the App to locate and disturb rare or endangered plants.

5. Your content

You retain ownership of the photos you take. By submitting a photo for identification, you grant us and our identification providers the limited right to process it to deliver the service. If you contribute photos to enrich species cards, you grant us a non-exclusive license to display them within the App.

6. Intellectual property

The App, its design, and its content (excluding your photos and third-party data) are owned by Caporuscio Consulting, LLC and protected by applicable laws.

7. Disclaimers and limitation of liability

The App is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Caporuscio Consulting, LLC disclaims all warranties and shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

8. Changes

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles.
